1. Provider identification

The Klusto service (hereinafter, “the Service”, “the Platform” or “Klusto”) is operated by BMD Creatives, LLC (hereinafter, “BMD”, “the Provider”, “we”), a limited liability company organized under the laws of the State of Wyoming, United States of America, incorporated on January 2, 2026.

2. Purpose

These Terms and Conditions govern access to and use of the Klusto plugin for WordPress and the klusto.ai website, as well as any related services provided by BMD Creatives, LLC. By acquiring a license or creating an account, the user accepts these terms in their entirety.

3. Service description

Klusto is a WordPress plugin that automates the planning and generation of SEO content through artificial intelligence. The service includes, depending on the contracted plan:

  • Automatic analysis of the user’s site to detect content gaps.
  • Topic cluster planning (BOFU/MOFU/TOFU).
  • Generation of SEO-optimized articles via the Claude API (Anthropic).
  • Direct publishing on the user’s WordPress installation.

Klusto is NOT a ranking guarantee service. SEO results depend on multiple factors external to the Service (domain authority, competition, configuration quality, etc.).

4. Plans and pricing

Klusto is offered under a monthly or annual subscription model with different tiers (Starter, Pro, Studio, Agency). The specific prices and features of each plan are available at klusto.ai/#pricing. BMD reserves the right to modify prices, giving prior notice of at least 30 days to active subscribers.

Free trial: Klusto offers a 7-day trial period with no credit card required. After the trial, the user must activate a subscription to continue using the service.

5. Claude API (Anthropic)

Klusto uses Anthropic, PBC’s Claude API for content generation. Depending on the contracted plan:

  • Demo and Starter: the API is included (we pay it). Model limited to Claude Sonnet, with monthly limits according to the plan.
  • Pro, Studio, Agency: the user must provide their own Anthropic API key, paying Anthropic directly for usage costs.

The user acknowledges that AI-generated outputs are probabilistic, may contain errors or inaccuracies, and must be reviewed before public publication. BMD does not guarantee the veracity, originality, or specific suitability of generated content, and is not responsible for consequences arising from the publication of such content without review.

6. Acceptable use

The user agrees not to use Klusto to:

  • Generate content that infringes copyright, trademarks, or other intellectual property rights of third parties.
  • Produce defamatory, fraudulent, misleading, illegal, discriminatory, or hate-promoting content.
  • Perform SEO techniques prohibited by search engine guidelines (spam, cloaking, duplicate content farms, artificial link networks).
  • Generate sexually explicit, violent content, or content involving minors in inappropriate contexts.
  • Impersonate real persons or organizations without authorization.
  • Circumvent the technical limits of the contracted plan (multi-sites, monthly posts, etc.).
  • Resell, sublicense, or redistribute the plugin to third parties without BMD’s express authorization.

BMD reserves the right to suspend or cancel accounts that violate these conditions, without refund, with prior notification when reasonably possible.

7. User account and license

The user is responsible for maintaining the confidentiality of their credentials and license key. Any action performed with the user’s account will be the responsibility of the holder.

The Klusto license is personal and non-transferable. Each plan allows a limited number of active installations (sites) as indicated in the contracted plan.

8. Subscription and automatic renewal

Subscriptions automatically renew at the end of each billing period (monthly or annual), charging the registered payment method. The user can cancel the renewal at any time from their customer panel, maintaining access to the service until the end of the paid period.

Billing is processed by Paddle.com Market Limited or another Merchant of Record contracted by BMD, who acts as a reseller of the service for tax purposes in applicable jurisdictions.

9. Refund policy

BMD offers a 14-day refund guarantee from the initial purchase date, no questions asked. Subsequent renewals are non-refundable. See the full Refund Policy for details, exceptions, and request procedure.

10. Intellectual property

The Klusto plugin, its source code, brand, logos, documentation, and website materials are the exclusive property of BMD Creatives, LLC. The user obtains only a limited, non-exclusive, non-transferable, revocable license to use the Service according to the terms of the contracted plan.

Content generated by AI within the plugin belongs to the user, without prejudice to Anthropic’s rights over the underlying models and the general restrictions of acceptable use.

11. Privacy and data protection

The processing of the user’s personal data is governed by our Privacy Policy, which forms an integral part of these terms. For European Union users, BMD complies with the General Data Protection Regulation (GDPR) through standard contractual clauses (SCCs) for international transfers.

12. Limitation of liability

The Service is provided “as is” and “as available”. To the maximum extent permitted by applicable law, BMD will not be liable for:

  • Indirect, incidental, special, consequential, or punitive damages.
  • Loss of data, revenue, profits, or reputation arising from use of the Service.
  • Interruptions caused by failures of third-party services (Anthropic, hosting, Brevo, Paddle, etc.).
  • User decisions based on AI-generated outputs.

BMD’s total cumulative liability for any claim related to the Service shall not exceed the amount paid by the user in the twelve (12) months preceding the cause of the claim.

13. Indemnification

The user agrees to indemnify and hold harmless BMD, its officers, employees, and affiliates from any claim, damage, or cost (including legal fees) arising from: (a) violation of these terms by the user; (b) use of the Service in infringement of third-party rights; (c) content published through Klusto that violates applicable law.

14. Service modifications

BMD may modify, suspend, or discontinue the Service (or parts of it) at any time, with or without notice. In case of permanent discontinuation of the Service, BMD will refund the proportional unused part of the subscription.

15. Modifications to the terms

BMD may update these terms. Material changes will be notified by email to the registered user at least 30 days in advance. Continued use of the Service after the effective date constitutes acceptance of the modified terms.

16. Governing law and jurisdiction

These Terms are governed by the laws of the State of Wyoming, United States, without regard to its conflict of laws principles. Any dispute arising from these terms shall be submitted to the exclusive jurisdiction of the competent courts of the State of Wyoming.

Exception for consumers in the European Union: This clause does not affect the mandatory consumer protection rights provided by the legislation of the country of residence of the consumer user in the EU, including the right to initiate legal action in their place of residence.

17. DMCA and intellectual property claims

If you believe that content hosted or generated through Klusto infringes your intellectual property rights, send us a notification at get@klusto.ai with the subject “DMCA Notice” including: (a) identification of the protected work; (b) identification of the infringing material; (c) your contact information; (d) sworn statement of good faith; (e) electronic or physical signature of the owner or authorized representative.

18. Severability

If any clause of these terms is declared null or unenforceable, the remaining provisions shall remain in full force and effect.
